A team of storm-chasing scientists sampling rarefied air has found a world of bacteria and fungi floating about 30,000 feet above Earth. The findings, detailed Monday in the Proceedings of the National Academy of Sciences, suggest that microbes have the potential to affect the weather.
Scientists have long studied airborne bacteria, but they typically do so from the ground, often trekking to mountain peaks to examine microbes in fresh snow. Beyond that, they don't know much about the number and diversity of floating microbes, said study coauthor Athanasios Nenes, an atmospheric scientist at Georgia Tech.
To get a glimpse of this hovering world, Nenes and his colleagues hitched several rides on a NASA aircraft as onboard instruments sampled the air before, during and after hurricanes Earl and Karl in 2010. The plane flew into the upper troposphere, about 6 miles above the surface.
During nine flights ? most over the Caribbean and the midwest Atlantic ? the researchers ran the outside air over a series of filters, each time capturing material from an average of 212 cubic feet of ambient air. They sampled a variety of environments, from the cloudy masses that preceded Hurricane Earl to the cloud-free air after Hurricane Karl passed.
The researchers focused on a ribosomal RNA gene called SSU rRNA, which can reliably identify bacterial species. They calculated that there were about 144 bacterial cells per cubic foot of air.
The bacteria accounted for 20% of the particles in their size range ? stuff that scientists had assumed was just sea salt and dust.
"We were surprised," Nenes said.
The filters picked up fungi too, though in concentrations that were at most only 10% as high as for the bacteria.
The microbial populations were very different before and after a storm, Nenes said; that makes sense, given that hurricanes have the potential to kick a fresh batch of bugs into the air.
Among other types, the scientists found Escherichia and Streptococcus bacteria in their samples ? microbes typically associated with human and animal feces that could have been thrown into the air as the storms swept through populated areas.
The researchers identified 17 types of bacteria that were found in all the samples, leading the team to suspect that those organisms constituted a core microbiome for the lower atmosphere. These bacteria must have developed traits that allowed them to bear freezing temperatures, feed on the scarce carbon compounds in cloud dust and survive in an environment bombarded by ultraviolet radiation.
Other studies have revealed the presence of plant-based microbes that are thought to induce freezing in order to damage leaves and then infect them.
Microbes with this freezing ability could conceivably collect water vapor and seed clouds, causing them to release rain. It could very well represent a way of transporting microbes across continents, Nenes said.
That possibility also has implications for the ways in which illnesses spread, he added.
"Once you get to that altitude, if you can survive, you can basically circulate the Earth very quickly," Nenes said. "You can start out in Europe and end up in Asia."
The finding could be exciting for astrobiologists, who wonder about the extreme environments in which bacteria can live on Earth ? and whether they could do so on other planets as well.
"It definitely lends to the idea that life is pretty resilient and you can adapt to almost any environment if you have a bare minimum of sustenance," Nenes said.
The paper provides a fascinating preliminary census of the airborne microbes, said David Sands, a bacteriologist at Montana State University who was not involved in the study.
But such research has a long way to go before proving that microbes in the atmosphere are doing anything other than waiting for their slow fall back to Earth, he added.
"If they go up, they want to get back down," Sands said.

URIBANA, Venezuela (Reuters) - Venezuelan authorities transferred inmates out of a prison on Sunday following a bloody riot two days earlier that killed 58 people and again highlighted chaos in the country's jails.
It was the fourth high-profile incident in 18 months in a penal system that has experienced repeated fatal clashes and shootouts. Venezuela's prisons house three times the number of inmates they were designed to hold.
The violence broke out at the Uribana jail as cancer-stricken President Hugo Chavez continues receiving treatment in Cuba and Vice President Nicolas Maduro - the notional head of state - visited him in Havana then flew to a summit in Chile.
In surprisingly candid comments to state TV, Prisons Minister Iris Varela acknowledged that weapons-smuggling enabled by corrupt prison workers had let armed gangs effectively control the run-down facility, near the city of Barquisimeto in southwestern Venezuela.
"It was nearly impossible to operate a penitentiary here given the level of violence," Varela told a news conference. "This is part of the corruption of some officials. We have opened battle lines against them."
Varela said 2,000 male prisoners and 130 female prisoners were being transferred to other facilities, while 46 remained in hospital recovering from injuries.
The government did not provide its own official number of 58 dead until late on Sunday afternoon. A hospital official had earlier put the death toll at 61.
Television images showed the burnt remains of cells that had been burned by prisoners. Makeshift shacks with teetering roofs and exposed electrical wiring, built by inmates in the overcrowded prison, lay charred by the blaze.
Prisoners had been raising goats and chickens inside the grounds, Varela said, and had an extensive network of tunnels for escape and trafficking.
She said the inmate gangs had probably wanted to stay, most likely because of the ample opportunity for lucrative illicit business within the jail.
"The prisoners didn't escape from here en masse because they didn't want to," she said. "If all the men that were in here pushed the wall, they would have knocked it over."
INSPECTION TRIGGERED RIOT
On Friday, the authorities had attempted to carry out an inspection at Uribana targeting the gangs' weapons, but were unable to do so because of armed resistance, the minister said.
Searching through the wreckage on Sunday, officers found a hand grenade and the charred remains of an unidentified body, which was included in the official toll.
Earlier in the day, relatives gathered outside voiced anger at the lack of information about where inmates were being sent.
"We're suffering here, and the government is saying nothing," said Josefina Ramirez, 36, seeking information about her 25-year-old husband. "We want Chavez to come here to give us news. We want an answer."
Chavez has not been seen in public nor heard from in 45 days, an absence that has spurred criticism from opposition leaders that the country is effectively without a president. Allies insist he is fully carrying out his duties.
Maduro promised a full investigation of the incident just after returning to Venezuela from Havana on Saturday. Within hours, he left to meet with Latin American and European dignitaries at a summit in Chile.
Brazilian President Dilma Rousseff scrapped her agenda at that summit and returned home after a nightclub fire killed at least 233 people early on Sunday.
Varela had earlier blamed opposition media for reporting the search, which she said triggered the violence. Prisons have been a growing headache for the Chavez administration.
Inmates refusing to be transferred out of a Caracas prison battled security forces in May for days as smoke rose above the compound and shots rang out. Chavez later said he called from Cuba, where he was receiving treatment, and spoke with one of the inmates to help negotiate an end to the standoff.
Local media last year published a story about a nightclub called Disco Tokio that held a Mother's Day party that featured musical groups flown in from Colombia and Puerto Rico. The club was located inside the Tocoron jail.
An online animated series about jail violence called "Jail or Hell," produced by a former inmate, has drawn a following among Venezuelans captivated by the chaos of the prisons.

You can check out his dimensions (186 centimeters), select language (he's trilingual), add him to your cart (which brings up a contact form), or even purchase related products like an airline ticket and some Asics (he's a runner, it seems). And, of course, you can read his customer reviews. They average five stars, of course, but there are a surprising number of one-star ratings?"lots of ex-girlfriends," Dubost explained via Twitter.
The page has gone viral, pushing the limits of Dubost's server capacity, and he had to fix his contact form after the number of submissions exceeded the cap for his free account with online form-builder Wufoo.
A good chunk of the traffic came from a post Thursday by Mashable's Chris Taylor, who wrote, "We don't actually know if Philippe Dubost is any good at his job. But boy, can he throw together a resume."
Actually, though, I'd say we do have a pretty good idea of how good Dubost is at his job. The guy is a web product manager, and his resume is per se a wildly successful web product. And as his Twitter feed attests, Dubost has been working day and night for the past 36 hours to respond to praise, media requests, and constructive criticism. I look forward to finding out who snaps him up.

Jan. 28, 2013 ? Japanese researchers show for the first time that primates modify their body movements to be in tune with others, just like humans do. Humans unconsciously modify their movements to be in synchrony with their peers. For example, we adapt our pace to walk in step or clap in unison at the end of a concert. This phenomenon is thought to reflect bonding and facilitate human interaction. Researchers from the RIKEN Brain Science Institute report that pairs of macaque monkeys also spontaneously coordinate their movements to reach synchrony.
This research opens the door to much-needed neurophysiological studies of spontaneous synchronization in monkeys, which could shed light into human behavioral dysfunctions such as those observed in patients with autism spectrum disorders, echopraxia and echolalia -- where patients uncontrollably imitate others.
In the research, recently published in the journal Scientific Reports, the team led by Naotaka Fujii developed an experimental set-up to test whether pairs of Japanese macaque monkeys synchronize a simple push-button movement.
Before the experiment, the monkeys were trained to push a button with one hand. In a first experiment the monkeys were paired and placed facing each other and the timing of their push-button movements was recorded. The same experiment was repeated but this time each monkey was shown videos of another monkey pushing a button at varying speeds. And in a last experiment the macaques were not allowed to either see or hear their video-partner.
The results show that the monkeys modified their movements -- increased or decreased the speed of their push-button movement -- to be in synchrony with their partner, both when the partner was real and on video. The speed of the button pressing movement changed to be in harmonic or sub-harmonic synchrony with the partners' speed. However, different pairs of monkeys synchronized differently and reached different speeds, and the monkeys synchronized their movements the most when they could both see and hear their partner.
The researchers note that this behavior cannot have been learnt by the monkeys during the experiment, as previous research has shown that it is extremely difficult for monkeys to learn intentional synchronization.
They add: "The reasons why the monkeys showed behavioral synchronization are not clear. It may be a vital aspect of other socially adaptive behavior, important for survival in the wild."

Renowned Irish rock band U2 and The American Ireland Funds announced in 2009 that they were to establish a national music education program to help children and young people access music tuition in their local area.
The Ireland Funds website reports that U2?s Adam, Bono, Larry and The Edge said: ?As a band, we believe music tuition should be available to anyone who wants it, whatever their background. We want to help to make this happen for Ireland?s children and young people - our ?music generation? of the future.
?We hope that Music Generation will inspire Ireland?s young musicians, who might not otherwise get access to such valuable teaching. We are delighted to see the progress of Music Generation and to be involved in this much-needed initiative for Ireland.?
According to Hotpress.com, the Department of Education are to start helping fund the Music Generation project. U2 and The Ireland Funds have announced that they will introduce the program to young people in Ireland through a ?7 million initiative, a lead gift of ?5 million from U2 and an additional ?2 million to be raised by The Ireland Funds.
?The Department of Education and Skills will commence funding the initiative on a phased basis from July 2014,? confirms Minister Ruairi Quinn.
?By 2016, the investment by local Music Education Partnerships and government is expected to be on a par with the donation from U2 and The Ireland Funds. Music Generation is a great example of how when we put our heads together we can deliver really exciting education programmes in new and innovative ways.?
Minister Quinn was speaking at the launch of Developing Diversity In Music Education In Ireland, a two-year initiative that?s being run in association with St. Patrick?s College.

CAIRO (AP) ? Egyptian security officials say a senior police officer and a policeman were shot dead in the Mediterranean city of Port Said after a judge sentenced 21 people to death in connection to one of the world's deadliest incidents of soccer violence.
Officials say that the police were killed when relatives tried to break into the Port Said prison to free the 73 defendants in the case held there.
At least 75 people were wounded in Saturday's violence outside the prison. Port Said residents also cut off the main road leading to the city.
Officials spoke anonymously in line with regulations.
The violence comes after a judge sentenced fans of Port Said's Al-Masry team to death for taking part in the Feb. 1, 2012, soccer violence, which killed 74 fans of Cairo's Al-Ahly club.

Now that President Obama's inaugural festivities are over, he will turn his attention to tackling gun control, immigration, climate change and a series of looming budget confrontations with Republicans. Obama and his aides hope that the winding down of the wars in Iraq and Afghanistan will help him maintain a focus on domestic priorities.
?Since 9/11, that region has been a sinkhole of American resources, lives and political capital,? says Charles Kupchan, an expert at the Council on Foreign Relations. ?The real drain of resources ?is diminishing and I think that Obama will make sure that continues.?
But as the crises in Mali and Algeria show, Obama will not have the luxury of focusing solely on domestic issues. A number of pressing foreign policy problems will demand his time and attention. Here is a look at seven big national security challenges he will face over the next four years:
Afghanistan and Pakistan: When Obama met earlier this month with Afghan President Hamid Karzai, the administration said it was considering removing all U.S. troops from Afghanistan when the NATO-led combat mission ends in 2014. Karl Inderfurth, a former assistant secretary of state for South Asian affairs, says the administration must make good on a promise of a responsible withdrawal. Also crucial for Obama will be managing the U.S. relationship with Pakistan, which has been fraught with tension. ?Pakistan is a pressing priority because the whole withdrawal (and) transition taking place in Afghanistan could not be done successfully without some form of Pakistani cooperation,? says Inderfurth, who is now with the CSIS think tank. ?But Pakistan also is a country that, because where it resides in the region, because it is a nuclear power, because it is itself at risk of Islamic extremists, if something goes seriously wrong in Pakistan, this could be a serious national security threat to the United States.? Having John Kerry as secretary of state will be an advantage. The secretary of state-designate has traveled there on behalf of the Obama administration and already has relationships with top officials.
Pivot to Asia and engaging new Chinese leadership: In 2011, Secretary of State Hillary Clinton?s declaration of a ?Pacific Century? signaled the start of a ?pivot? to Asia that has involved stepped-up U.S. engagement in the region. As part of that effort, Obama traveled to Asia right after the election on a tour that included a historic visit to Myanmar. While many U.S. allies in the region have welcomed the U.S. engagement, the initiative is viewed warily in Beijing. The Obama administration has been seeking to reassure China that the pivot is not aimed at containing Beijing?s influence. In November, Xi Jinping was named the new head of the Chinese Communist Party, taking over from Hu Jintao in a once-in-a-decade leadership transition. Establishing a good working relationship with the new Chinese leadership is critical.
Standoff over Iran?s nuclear program: When Obama took office in 2009, he signaled a willingness to engage personally with Tehran, saying in his first inaugural speech that the United States would ?extend a hand if you are willing to unclench your first.? The gesture was aimed at showing Iran ? and U.S. allies ? that his administration was willing to try to diplomacy first to make headway on the nuclear issue. The West accuses Tehran of using its nuclear enrichment program to try to build a nuclear weapon while Iran insists its nuclear program is aimed at purely peaceful purposes of developing electricity. The outreach did not lead to any breakthroughs so the Obama administration shifted its focus to working with U.S. allies to put in place stiff economic sanctions. Years of sanctions are taking a ?toll on Iran?s economy. In the coming months, the United States will try direct talks with Iran. As he winds down the war with Afghanistan, the last thing Obama wants is another military engagement. But he has repeatedly said that a nuclear Iran is unacceptable. If sanctions and negotiations fail, the prospect of U.S.-led military action would grow.
Hotspots in Africa and the Middle East: The crises in Mali and Algeriaserve as a bleak reminder that several smaller conflicts around the globe could engulf an entire region. The Obama administration has resisted involvement in the Mali conflict for a variety of reasons. But clashes with Islamic militants in Somalia and Yemen could increase, as the U.S. ramps up its drone attacks. Additionally, clashes with rebels in some Sub-Saharan nations, such as the Central African Republic and the Democratic Republic of the Congo have also garnered U.S. attention. If these conflicts grow, it might become necessary for the U.S. to put more resources and political capital in these areas.
Israeli-Palestinian conflict: Two days before Obama?s first inauguration, Israel and Hamas agreed to a ceasefire to their three-week war that left nearly 1,500 Palestinian dead and chances for a peace deal slim. Four years later, the two sides find themselves in an equally precarious situation, fresh off a new conflict and with political conditions less than ideal. On Tuesday, Israelis are expected to keep Benjamin Netanyahu in power as prime minister, bringing with him a more hardened conservative coalition unlikely to support a broader two-state solution. Any new peace initiative must take account of a ?loss of faith among both Israelis and Palestinians about the prospects of a real resolution,? said Tamara Cofman Wittes, a senior fellow at the Brookings Institution. ?Without paying attention to the politics, such an initiative is destined to fail.? Wittes says that the U.S. can have intensive discussions with each side individually to get beyond these political divides and find a solution that could cement Obama?s legacy.
Syria: President Bashar al-Assad's crackdown on the Syrian uprising has left 60,000 dead, according to United Nations estimates. The Obama administration has steered clear of military involvement but Washington is concerned about the potential that the Assad government might use chemical weapons. If that were to happen, it would cross a red line for the United States and could prompt military intervention. In any event, the humanitarian catastrophe from the Syrian conflict and its wider mplications for the region mean will demand constant monitoring.
?Reset? of the ?reset? with Russia: Obama came into office in 2009 pledging a reboot in relations with Moscow, which had deteriorated in the final years of President George W. Bush's administration. The Obama administration viewed the ?reset? with Russia as important to many of its foreign policy priorities, including the mission in Afghanistan and stepping up pressure on Iran over its nuclear program. Obama established a rapport with then-President Dmitry Medvedev and ties between the two countries improved. But Vladimir Putin is now president again and relations between Moscow and Washington have soured in recent months. In retaliation for the Magnitsky Act, which calls for U.S. sanctions on Russian officials who violate human rights, Russia has banned adoptions by U.S. families of Russian children. Obama is expected to visit Russia later this year. Analysts say the engagement will be important, though few believe there will be a huge improvement anytime soon in relations.

Manet worked directly onto the canvas, shaping each composition with an arresting immediacy.
In a show of around 60 paintings, Manet?s perfectly calculated sense of uncertainty permeates every scene, elusive and complex. Full of riddles within riddles, they allow us to rediscover and reinterpret his enormous skill for mysterious vignettes.

In a collaborative effort published online in the January 18, 2013 issue of the journal Science, researchers at the University of North Carolina and Columbia University show for the first time how two key proteins in messenger RNA communicate via a molecular twist to help maintain the balance of histones to DNA.
Histone proteins are the proteins that package DNA into chromosomes. Every time the cell replicates its DNA it must make large amounts of newly made histones to organize DNA within the nucleus.
An imbalance in the production of DNA and histones is usually lethal for the cell, which is why the levels of the messenger RNA (mRNA) encoding the histone proteins must be tightly controlled to ensure the proper amounts of histones (not too many and not too few) are made.
In a collaborative effort published online in the January 18, 2013 issue of the journal Science, researchers at the University of North Carolina and Columbia University show for the first time how two key proteins in messenger RNA communicate via a molecular twist to help maintain the balance of histones to DNA.
"This is one of the safeguards that our cells have evolved and it is part of the normal progression through cell division -- all growing cells have to use this all of the time," said study co-author William F. Marzluff, PhD, Kenan Distinguished Professor of biochemistry and biophysics at UNC's School of Medicine.
Every time a cell divides, Marzluff adds, it has to replicate both DNA and histone proteins and then package them together into chromosomes. "That way, each of the two cells resulting from division has one complete set of genes."
In humans, the 23 chromosomes that house roughly 35,000 genes are made up of both DNA and histone proteins. The DNA for a histone protein is first transcribed into RNA, which then acts as a guide for building a histone protein. Because the RNA relays a message -- in this case a blueprint for a histone protein, it is referred to as messenger RNA, or mRNA.
Histone mRNAs differ from all other mRNAs and end in a stem-loop [or hairpin] sequence that is required for proper regulation of histone mRNAs. In this study, the Columbia team of Liang Tong, PhD, Professor of biological sciences and the corresponding author on this project, and graduate student Dazhi Tan used crystallography to reveal the structure of two important proteins near the end of the histone mRNA stem-loop. This molecular complex is required for regulating the levels of the histone mRNA.
One of these proteins, stem-loop binding protein (SLBP) is required for translation of histone mRNA into protein, and the other is an exonuclease, which is required to destroy the mRNA. Both were initially identified at UNC by Marzluff and colleague Zbigniew Dominski, PhD, Professor of biochemistry and biophysics, also a study co-author.
"We knew there was some interaction between SLBP and the exonuclease, so we asked Liang to explain how they bind and communicate," Dominski said. "And the surprising thing was that the proteins do it not by binding to each other but by changing the RNA structure at the site."
"From the science point of view, that was the most dramatic thing," Marzluff said. "The way these proteins help each other is either one can twist the RNA so the other can recognize it easier, and they don't have to touch each other to do that."
This protein complex is a critical regulator of histone synthesis, and is an important component of cell growth, he adds. "Interfering with it could provide a new method for interfering with cancer cell growth."
Funding for the research came from the National Institute of General Medical Sciences (NIGMS), a component of the National Institutes of Health.

CAPE TOWN (Reuters) - A man died after he was hit by a rubber bullet during clashes between police and striking farm workers demanding higher wages in one of South Africa's main grape-growing regions, a police spokesman said on Tuesday.
The 23-year-old was the third person to die in a series of protests by workers in rural areas around Cape Town - the latest outburst of labor unrest to hit Africa's largest economy.
The man was hit as police confronted stone-throwing protesters in the town of De Doorns on Monday as a walk-out by thousands of farm workers entered its second week.
He died later that day in hospital and an independent police watchdog was now looking into the matter, said police spokesman F.C. van Wyk.
Two protesters were killed in similar circumstances in November when thousands of fruit pickers and packers in rural towns in the same area downed tools to demand a doubling of basic daily wages to 150 rand ($17.22) from the current 69 rand.
There has little let-up in a wave of labor unrest that began six months ago in the country's platinum mines and then swept through the trucking and agriculture sectors.
South Africa, struggling with slow economic growth, is also bracing for job losses and more unrest in its crucial mining sector, responsible for about 6 percent of the economy.
On Tuesday the world's top platinum producer, Anglo American Platinum said it would cut 14,000 jobs.

After opting not to offer its Total Equipment Protection (TEP) service to iPhone customers, Sprint appears to have turned over a new leaf. An anonymous tipster has shared an internal screenshot with us noting that starting on January 25th, the carrier will start allowing its iPhone users to select TEP as an equipment insurance option. Similar to its policy with AppleCare+, Sprint will give customers 30 days from the date of purchase to add TEP to their account at a monthly charge of $11. However, unlike Apple's in-house coverage plan, Total Equipment Protection claims come with hefty deductibles ranging from $150 - $200, instead of a one time upfront charge. So, if you were looking to pick up an iPhone from Sprint and AppleCare+ wasn't exactly ringing your bell, you'll soon have an additional insurance option in less than a fortnight.

Labor attorneys share tips on intricacies of government contracting
With the state budget deficit a higher priority than an off-year bonding bill and more transportation projects, private contractors might be wondering about their chances of gaining work with public entities this year.
The good news, according to attorneys who work in that sector, is that the work is out there if you don?t mind hunting for it. Gaining work with city, county and state agencies can be lucrative and rewarding, but there are some issues to consider.
For one thing, keep in mind that each of Minnesota?s 853 cities and 87 counties has its own way of operating, said Robert J. Alfton, a labor and employment lawyer with Cummins & Cummins in Minneapolis.
?You can?t assume that the city of Bemidji operates the same as Minneapolis,? said Alfton, a former city attorney for the city of Minneapolis. ?They?re different in their legal structure ? some are statutory cities, some are charter cities.?
Fortunately, most cities and counties document and publish their various structures, regulations and mandates on their websites, giving business owners little excuse for not knowing what?s expected from them.
St. Louis Park attorney Gregg Corwin agreed, adding that the leadership of public entities can differ widely: A city might operate under a weak-mayor system in which department heads wield relatively greater power.
?You can?t look at government entities as a monolith,? said Corwin. ?They?re made up of individuals. You might find that dealing with a building official in one city is completely different from dealing with someone in the same position from a city 50 miles away. Get to know the individual.?
Part of that getting-to-know-you process means becoming a regular presence at council and board meetings as well as keeping your eyes open for events that may help to get your name in front of the right players.
According to Marylee Abrams of Abrams & Schmidt in Arden Hills, both the League of Minnesota Cities and the Association of Minnesota Counties have annual conferences where business owners can rent booth space.
Diversity is key
From a legal standpoint, some ongoing issues need to be watched by businesses that want to gain public-entity work, one of which is diversity ? not just in the bidding and hiring process but also in the makeup of business ownership.
A number of public agencies have adopted programs to advance the hiring of minority- and women-owned businesses, according to Brendan Cummins, also with Cummins & Cummins.
?Public agencies have a strong interest in expanding the sphere of who they?re doing business with, and that often includes small businesses,? said Cummins.
He pointed to the example of Minneapolis, which passed an ordinance favoring small and under-utilized businesses. Chapter 423 of the city code, better known as the Small and Underutilized Business Program (SUBP), establishes goals for hiring women- and minority-owned small businesses.
?The goal, as they see it, is to level the playing field in contracting,? said Cummins. ?You see this kind of public policy being carried out in public contracting in a number of locations.
?A lot of contractors might think it?s just about the low bid, but there are a lot of public policy goals, particularly involving diversity, that public entities are pushing.?
That viewpoint is similar at the state level, although rules of construction contracting place a greater emphasis on the makeup of a company?s work force than on owner status. The state Department of Human Rights has set its work force goals ? not mandates ? for state-funded construction projects minorities in Hennepin and Ramsey Counties at 32 percent minorities and 6 percent women.
?This requires a substantial reworking of the business model a lot of contractors have used,? said Cummins. ?Businesses have had to look at who they?re hiring.?
?Have the facts ready about your minority and women employees in case the subject comes up, because it probably will come up,? said Alfton.
Keep an eye on the Capitol
Another legal issue is that union membership among public employees is many times what it is in the private sector ? 37 percent in the former as opposed to about 7 percent in the latter, according to figures from the federal Bureau of Labor Statistics.
?You?ll need to keep that in mind as you bid,? said Alfton. ?It can affect everything about the project, starting with the budget.?
Finally, attorneys recommend keeping a close eye on the Legislature. The jury is out on bonding, and will likely stay that way. But even absent a nine-digit bonding measure like we saw last year, that doesn?t mean state-funded projects won?t be approved piecemeal.
?Stability in state funding is a big issue for our public-sector clients ? there are a lot of cities that get local government aid,? said Abrams. ?And I see transportation being a big topic this session ? finding ways to pay for a lot of transportation projects that have been sitting on the books for a long time.?

NEW YORK (AP) ? Police in New York City plan to combat the theft of painkillers and other highly addictive prescription medicines by asking pharmacies to hide fake pill bottles fitted with GPS devices amid the legitimate supplies on their shelves.
Police Commissioner Raymond Kelly is expected to unveil the plan Tuesday at a La Quinta, Calif., conference on health issues hosted by former President Bill Clinton's foundation.
While pharmacies elsewhere in the country have experimented with so-called bait bottles in the past couple of years, the New York Police Department would take a more comprehensive approach by encouraging thousands of pharmacies to stock the bottles.
In prepared remarks provided before his appearance, Kelly says the initiative was prompted by a spate of high-profile crimes associated with the thriving black market for oxycodone and other prescription drugs, including the slaying of four people on Long Island during a pharmacy holdup in 2011. He also cites the case of a retired NYPD officer who, after retiring with an injury and getting hooked on painkillers, began robbing drug stores at gunpoint.
Prescription drug abuse "can serve as a gateway to criminal activities, especially among young people," the commissioner says. "When pills become too expensive, addicts are known to resort to cheaper drugs such as heroin and cocaine. They turn to crime to support their habit."
The NYPD has begun creating a database of the roughly 6,000 pharmacies in the New York City area with plans to have officers visit them and recommend security measures like better alarm systems and lighting of storage areas. Kelly says it also will ask them to adopt use of the bottles with GPS devices.
"In the event of a robbery or theft, we'll be able to track the bottle, which may lead us to stash locations across the city," he says.
The devices will be provided by Purdue Pharma, the manufacturer of OxyContin, and a private firm will initially monitor them, police said.
A Purdue Pharma spokeswoman said Tuesday that the company was "working closely with New York City police on this project," but declined to comment further.
Bridget Brennan, special narcotics prosecutor for New York City, welcomed the NYPD initiative.
"It's an excellent use of available technology to address a real problem," Brennan said Tuesday.
Kelly's announcement also signals that fighting prescription drug abuse "has become a real priority for the NYPD," she added.
During a pharmacy robbery in 2010 in Maine, a worker planted a GPS bottle in a bag with other bottles containing oxycodone and other drugs and gave it to a robber who had used a note to threaten to shoot the employee. Police credited the device with helping them track the suspect's movements before making an arrest.

FORT WAYNE ? Kyle Lindsay, the Bishop Luers offensive coordinator and son of embattled ex-coach Matt Lindsay, was named the Knights? football coach Friday.
?I am humbled and privileged, every positive emotion you can feel, that?s me right now,? Kyle Lindsay said during a phone interview.
Kyle Lindsay, a former Luers quarterback and 2002 graduate of the school, has been on the coaching staff for six years, serving as the offensive coordinator for the last four seasons.
Luers athletic director Jim Huth, who replaced Matt Lindsay in that capacity, would not disclose the number of candidates interviewed but said a smooth transition was a significant factor in the decision.
?In the end we thought Kyle was the best candidate for our kids and our program and the continued success,? Huth said. ?That was part of what we had to consider as we looked at candidates from inside and candidates from outside. The ultimate decision came down to that continuity question. We felt it was important.?
Kyle Lindsay, 29, said he was informed of his selection Friday.
Kyle?s father, Matt Lindsay, was fired four games into this past season after inappropriate videos were found on his school computer.
Matt Lindsay, who led the Knights to nine state titles as an assistant and head coach, has not been charged with any crime in the ongoing investigation.
Kyle Lindsay said he interviewed for the head coaching position before Christmas break.
?Any of the guys they interviewed would have been great choices,? said Kyle Lindsay, who also teaches social studies at Luers. ?There was some doubt, but at the same time there was some reassurance that in my initial interview they didn?t want a whole lot of change.?
Kyle Lindsay said he expects most, if not all, of the staff to remain intact.
Kyle Lindsay was the team?s interim coach for one game after his father was fired after three decades with the program.
Kyle Lindsay led Luers to a 27-7 win over Wayne on Sept. 14, but the game was forfeited after an academically ineligible player was found to have played.
After that game, former Luers coach Steve Keefer was elevated from the freshman program for the rest of the season and helped Luers (11-4) to a fourth straight Class 2A state championship.
The Knights have won 10 state titles, No. 2 in state history. Kyle Lindsay played quarterback on two championship teams in 1999 and 2001. He was also on the 2000 state runner-up team. He was an assistant coach on five state championship teams, in 2007 and 2009-12.
?Truthfully, not very long,? Kyle Lindsay said of wanting to be the Luers head coach. ?There was a time when I was working on my degree at Dayton when I realized it might be possible.
?At the same time, there are a lot of good, hard-working coaches and people out there who would have loved to have the job. I am really honored and appreciative that it was offered to me, and I am excited for the future of the program.?
